The Batoche Virtual Competition

GENERAL

  1. The Batoche Virtual Competition (“Competition”) is sponsored and conducted by The Royal Canadian Geographical Society, Canadian Geographic Enterprises and The Métis Nation-Saskatchewan (collectively the “Competition Administrators”).
  2. The Competition includes separate categories of competitions in 1) jigging (“Jigging (Red River Jig) Competition”), 2) fiddling (“Fiddling Competition”) and 3) square dancing (“Square Dance Competition”). These Rules and Regulations include overall rules for the entire Competition as well as additional rules specific for the Jigging (Red River Jig) Competition, Fiddling Competition and/or the Square Dance Competition.
  3. The Competition is a skill based competition and is open to all skill levels. No purchase is necessary to enter the Competition or to win a prize.
  4. Entry for the Competition opens on July 17, 2020, at 14:00:01 PM Saskatchewan Central Standard Time and will close on July 21th, 2020 at 23:59:59 PM Saskatchewan Central Standard Time (“Competition Entry Period”).
  5. All Competition entries must be submitted and received through the Competition website (the “Website”) before the close of the Competition Entry Period.
  6. Judging for the Competition will take place from July 23, 2020 at 00:00:01 AM Saskatchewan Central Standard Time until July 26, 2020 at 13:59:59 PM Saskatchewan Central Standard Time (the “Judging Period”).
  7. For the purposes of the Competition and these Rules and Regulations, the Competition group entities are: The Royal Canadian Geographical Society and Canadian Geographic Enterprises at 50 Sussex Drive, Ottawa, ON, K1M 2K1 and The Métis Nation-Saskatchewan at Suite 201, 208-19th Street West, Saskatoon, Saskatchewan, S7M 5X8, together with their directors, officers, employees, affiliates, advertising and promotion agencies, suppliers of materials and services related to the Competition or the Website and any other corporation, partnership, sole proprietorship or other person or legal entity directly or indirectly involved in the Competition (collectively, the “Competition Group Entities”)

ELIGIBILITY

  1. The Competition is open to Canadian citizens or permanent residents of Canada residing in any of the following provinces and territories at time of entry: British Columbia, Alberta, Saskatchewan, Manitoba, Ontario, Yukon, Northwest Territories, and Nunavut. Employees of the Competition Group Entities, their affiliates, advertising and promotional agencies, service providers and judges are not eligible to enter the Competition or to win a prize.

HOW TO ENTER

  1. The Competition may be entered online only, by completing the online entry form available on the Competition Website (www.backtobatochedays.ca) in full, submitting a video of their fiddling, jigging (Red River Jig), or square dance, and completing a consent form, before the close of the Competition Entry Period. Competition entries received by any other method or at any other time will not be accepted.

GENERAL COMPETITION VIDEO RULES

  1. These General Competition Video Rules apply to the entire Competition – including the Jigging (Red River Jig) Competition, Fiddling Competition and the Square Dance Competition.
    1. All entrants must record their own videos. No edited or professionally produced videos will be permitted.
    2. All entries submitted by a person under the age of majority in the province or territory within which the person resides (a “Minor”), must be accompanied by permission from the Minor’s parent or guardian.
    3. Before submitting any video, the entrant submitting the video must verify that all persons (or a parents/guardians of Minors) within the video have consented to these Rules and Regulations and must agree to the video being posted, judged and used as provided in these Rules and Regulations.
    4. All entrants and videos must comply/be in compliance with all applicable laws and regulations including, but not limited to, any laws, regulations, requirements, directives or orders relating to public health and safety measures including, but not limited to, disease and/or and infection containment or disease reduction measures and/or social (physical) distancing requirements.
    5. Minors at time of video filming, may not be included in a Competition video unless the prior written consent of the Minor’s parent/guardian has been obtained prior to entry. Competition Administrators reserve the right to request proof of parental/guardian consent. Failure to provide such proof as requested, will result in the disqualification of the entrant and all related Competition video(s) from the Competition.
    6. Competition videos may not include any content that is offensive, demeaning, disrespectful or unacceptable for general community viewing. Competition Administrators and Competition judges reserve the right to disqualify, in their sole discretion, any videos that contain unacceptable content including, but not limited to racist, hateful/hate-promoting, sexist, homophobic or pornographic content. Competition videos that breach copyright or contain personal information (including voice and image) of persons other than the entrant will also be disqualified from the Competition unless the consent referenced in these Rules and Regulations has been obtained. Entrants who use back up musicians or pre-recorded back up music for accompaniment purposes must have obtained all necessary consents/releases of copyright as applicable, prior to entering the Competition.
    7. Traditional Métis attire is encouraged; however, it is not required for videos entered in the Fiddling Competition or in the Jigging (Red River Jig) Competition.
    8. Square Dance Competition groups must wear square dance attire.
    9. For the Fiddling Competition and the Jigging (Red River Jig) Competition, if there are fewer than three entries in a category, prizes will be awarded to the category entrants (starting with 1st prize) and any prizes not awarded shall be distributed at the discretion of the judges as bonus prizes within the remaining competition categories – assuming there are sufficient numbers of entrants in the same competition category. Prizes will not be awarded across competition categories (i.e. Fiddling Competition prizes will not be awarded to entrants in the Jigging (Red River Jig) Competition).
    10. The Fiddling Competition, Jigging (Red River Jig) Competition and the Square Dance Competition will be judged by judging panels of three persons appointed by the Contest Administrators.
    11. Subject to these Rules and Regulations, all Competition video entries selected by a judging panel will be announced and posted on the Website once judging is complete. In addition, selected videos will be posted on the Website. The schedule for the posting/showing of the videos (the “Schedule”) will be posted on the Website. The selected videos will be streamed on the Website and on Facebook competition at the time noted on the Schedule. The Schedule is subject to change/modification.
    12. Instructions on how to register for the Competition may be found on the Competition Website.
    13. Entries must be complete and must include entrant’s name, age/category, city/town/village, province, contact info (including email). Incomplete entries may be disqualified from the Competition and be ineligible to win a prize.
    14. All entries (including video entries) become the property of the Competition Administrators and will not be returned. Entries may be used for promotions, advertising and educational purposes without further notice or compensation to Competition entrants.
    15. Any attempt by an entrant (or by a third party on behalf of an entrant) to bribe or sway the opinion of the judges or to otherwise interfere in the judging process will result in the immediate disqualification of the entrant from the Competition and the forfeiture of any prize.
    16. All judging decisions are final and binding and not subject to review or appeal.
  2. Additional Fiddling Competition Rules
    1. Competition tunes must be in the style of old time/Métis style.
    2. All Fiddling Competition entries must include a waltz in ¾ time, a jig in 6/8 time and a reel in 2/4 time in that order.
    3. Fiddling Competition videos may not exceed 5 minutes in length. During that time, entrants must introduce themselves, their tunes of choice and play all three tunes. Failure to play all tunes will result in a loss of points or disqualification at the discretion of the judging panel. Video content exceeding 5 minutes in length will be disregarded and will not form part of the judging for the video.
    4. Fiddling Competition videos will be judged on the following criteria: interpretation of Old time/Métis style, overall style, and versatility between tune styles. Entrants may play alone, with backup musicians or may use back up music tracks as accompaniment.
    5. The Fiddling Competition categories are set out below.
    6. If there are more than 8 entrants in the Intermediate category, the Intermediate category will be subdivided during the Judging Period:
      1. The top five entrants in the Intermediate category (as determined by the judges in their sole discretion) shall be separated from the remaining entrants in the Intermediate category to form part of a Championship category.
      2. The judges will evaluate and judge both the Intermediate category and the Championship category and award prizes in each of the Intermediate and Championship categories.
      3. Intermediate entrants may only form part of one category.
      4. If there are fewer than 8 entrants in the Intermediate category, no Championship category will be created. In that case, only the 3 prizes in the Intermediate category will be awarded by the judges. In such a case, the Championship prizes will not be awarded.
  3. Fiddling Competition Categories

  4. Additional Jigging (Red River Jig) Competition Rules
    1. Only traditional Métis jigging videos are eligible to enter the Jigging (Red River Jig) Competition.
    2. Videos of contemporary jigging are not eligible for entry into the Jigging (Red River Jig) Competition or to win a prize.
    3. Jigging (Red River Jig) Competition videos will be judged on the following criteria: interpretation and reflection of jigging (Red River Jig) tradition, timing, creativity and attitude. A point will be deducted if the entrant in the Jigging (Red River Jig) Competition is not wearing shoes.
    4. Contestants in the Junior category are expected to demonstrate two changes, Youth and Intermediate  contestants are expected to demonstrate three changes and the Seniors category is expected to demonstrate two changes.
  5. Jigging (Red River Jig) Competition Categories

  6. Additional Square Dance Competition Rules
    1. Métis attire is mandatory.
    2. Video must show traditional square dancing content.
    3. Square Dance Competition videos will be judged on the following criteria: interpretation of traditional square dancing, overall style and change transitions (1st change, 2nd change and/or 3rd change).
  7. Square Dance Competition Categories

    1 If more than 50% of the Youth group includes individuals who are over 16 years of age, that group will only be eligible to enter the Adult category.

    2 If fewer than 3 entries are received in each of the Youth and Adult categories, then all Square Dance Competition entries shall form part of one category and only one set of prizes (1st, 2nd and 3rd place) will be awarded.

JUDGING

  1. Competition video judging for each of the three Competitions will take place between July 23 and July 26, 2020. Judging panels will coordinate judging activities using online resources and communications during the Judging Period.
  2. A panel of judges will select a maximum of thirty-nine (39) videos as provided in these Rules and Regulations.
  3. All judging decisions are final and binding and not subject to review or appeal.

PRIZES

  1. In total, and subject to these Rules and Regulations, a maximum of thirty-nine (39) cash prizes are available to be awarded as follows:
    1. Jigging (Red River Jig) Competition: 18 prizes
    2. Fiddling Competition: 15 prizes
    3. Square Dance Competition: 6 prizes
  2. Once all winners have been confirmed, the cheques for the prizes will be delivered to the Winner by mail or by such other method of delivery as the Competition Administrators may determine. All prize amounts are in Canadian dollars. All prizes will be in the form of a cheque issued to the entrant who submitted the winning video. Competition Administrators may, in exception cases and in their sole discretion, agree with a Winner to issue a prize through a form or financial instrument other than a cheque.
  3. If other people participated in or contributed to a winning video, the Winner is solely responsible to determine how, if at all, the prize money will be shared.
  4. In no case shall the Competition Group Entities have any responsibility for any issues relating to the further division of prize money or for any taxes, fees or other charge associated with any prize. For greater certainty, any prize money will only be delivered to the individual Winner who entered the Competition. Allow 6 – 8 weeks for the prize cheques to be delivered after the Winners have been confirmed. Competition Group Entities are not responsible for any lost, stolen, misdirected, or delayed prize cheques.
  5. Except as otherwise provided below, one prize, of the amount indicated, will be awarded in each of the following categories:

WINNER CONFIRMATION, DECLARATION OF ELIGIBILITY AND RELEASE

  1. The entrants whose videos have been selected by a Competition judging panel (“Potential Winners”) will be announced on the Website on July 26, 2020.
  2. In order to be declared a winner of a Competition prize (a “Winner”), a Potential Winner, in addition to meeting the Competition eligibility criteria and otherwise complying with these Competition Rules and Regulations, will be notified by telephone by a representative of the Competition Administrators within three (3) business days after selection. The Potential Winner must respond within two (2) business days immediately following the date of the notification call.
  3. Prior to being declared a Winner, a Potential Winner must complete and return to the Competition Administrators a Declaration of Eligibility and Release in the form, and within the time, required by the Competition Administrators.
  4. The Competition Administrators reserve the right, in their sole and absolute discretion, to verify the information on the entry form of any entrant and/or Potential Winner.
  5. All Prizes must be accepted as awarded in these Rules and Regulations and cannot be transferred to another individual, substituted for another prize or exchanged in whole or in part for any other prize.
  6. If for any reason a selected entrant cannot be reached through the contact information provided, or if the Potential Winner does not respond as required above within two days of notification by the Competition Administrators, the entrant/Potential Winner will be disqualified and shall not be entitled to receive any prizes. An alternate Potential Winner will be selected by the judges following the process set out in these Rules and Regulations. Similarly, if a Potential Winner does not complete and return to the Competition Administrators the required Declaration of Eligibility and Release, or if there is any reason a Potential Winner or Winner cannot accept a prize as awarded, the Potential Winner’s/Winner’s entry will be declared null and void, any prize will be forfeited and another Potential Winner will be selected by the Competition judges.
  7. The decision of the Competition Administrators on all issues of Competition entry and qualification is final and binding and is not subject to review or appeal.

GENERAL TERMS AND CONDITIONS

  1. By entering the Competition, entrants agree to abide by these Competition Rules and Regulations and authorize the Competition Administrators and, at the Competition Administrators’ direction, their advertising and promotional agencies and their respective employees or other representatives to broadcast, publish and otherwise use Winner’s name, photograph, image, video, statements regarding the Competition or any prize, place of residence and (or) voice for publicity purposes, without any form of remuneration, including without limitation, on any website operated by or on behalf of the Competition Administrators.
  2. The validity of any Competition entry is subject to verification by the Competition Administrators.
  3. If any entry information is found to be false or misleading, or if an entrant is otherwise ineligible to enter the Competition or to win a prize, the Competition Administrators reserve the right, in their sole discretion, to disqualify that entrant.
  4. Any incomplete or fraudulent entries will be rejected. Any entrant or other individual who enters or attempts to enter the Competition in a manner which is contrary to these Competition Rules and Regulations or which is otherwise disruptive to the operation of the Competition or by its nature is unjust to other entrants or potential entrants will be rejected and that entrant or potential entrant will be disqualified from the Competition and forfeits any prize.
  5. The odds of winning a Competition prize depend upon the number of eligible entries received, the skill level of the Competition entrants and the overall quality of the videos submitted.
  6. Inappropriate online behavior will not be tolerated by the judges or by the Competition Administrators. Any entrant that is found to be misusing the Website, or using social media, or other forms of communication inappropriately may be disqualified at the sole decision of the Competition Administrators.
  7. All decisions of the Competition judges, who may be employees or independent contractors of the Competition Group Entities and/or the Competition Administrators and all decisions of the Competition Administrators, with respect to any and all aspects of the Competition, including without limitation the eligibility or disqualification of entrants or entries, the merit of any entry or the skill displayed in any video, are final and binding and not subject to review or appeal.
  8. The Competition Administrators reserve the right, in their sole and absolute discretion, to modify, cancel, terminate, limit or suspend the Competition, in whole or in part, in the event of any cause or circumstance, including without limitation any virus, computer bug or unauthorized human intervention, crisis (including but not limited to a public health crisis), unauthorized or automated voting, or any other cause that is beyond the control of the Competition Group Entities / Competition Administrators, that could corrupt or affect the administration, safety, public safety, security, impartiality or normal course of the Competition.
  9. By entering or attempting to enter the Competition, each entrant and/or purported entrant agrees: (i) to release, discharge, and forever hold harmless the Competition Group Entities, and their respective officers, directors, employees, shareholders, agents and other representatives (collectively, the “Releasees”) from any and all liability, claims, actions, damages, injuries, demands, manner of actions, causes of action, suits, debts, duties, accounts, bonds, covenants, warranties, indemnities, claims over, contracts and liabilities of whatever nature or kind arising out of, or in connection with (and including, but not limited to claims relating to copyright infringement, personal injury, illness or death) the entrant’s submission of any video, participation or attempted participation in the Competition, compliance or non-compliance with these Competition Rules and Regulations and acceptance of any prize. As noted above in these Rules and Regulations, prior to being declared a Winner, a Potential Winner must complete and return to the Competition Administrators a Declaration of Eligibility and Release in the form, and within the time, required by the Competition Administrators before declared a Winner and receiving a prize. The Declaration of Eligibility and Release will, among other matters, grant the Competition Administrators permission to publish in print, broadcast or online, the Winner’s name and likeness without remuneration. By entering the Competition, entrant agrees to the posting of the entrant’s Competition video(s) as provided in these Rules and Regulations.
  10. The Competition Group Entities are not and will not be responsible for lost, incomplete, late or misdirected entries or for any failure of the Competition Website during or after the Competition, or for any technical malfunction or other problems with, any telephone network or lines, computer online systems, servers, access providers, computer equipment or software or for any technical problems or traffic congestion on the Internet or at any website, or any combination of the foregoing, and will not be liable for any resulting injury or damage to any person or property arising from, or relating to, that person’s or any other person’s participation or attempted participation in the Competition. Any attempt to deliberately damage any website (including the Website) or to undermine the legitimate operation of the Competition is a violation of these Rules and Regulations and, should such an attempt be made, the Competition Administrators reserve the right to seek remedies and damages to the fullest extent permitted by law, and may, in an appropriate case, request that criminal prosecution be pursued.
  11. No communication or correspondence will be entered into with any Competition entrants about their specific Competition entries/videos, other than with Potential Winners and Winners.
  12. Personal information gathered about Competition entrants in connection with this Competition will be kept in a secure and confidential database, will not be rented or sold and will only be used as required/permitted by law or by these Rules and Regulations.   13. This Competition is subject to all applicable Federal, Provincial and Municipal laws. Void where prohibited.
